Welcome to Flowdown. These Terms of Service ("Terms") govern your access to and use of the Flowdown website at flowdown.io and all related services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you may not use the Service.

1. Acceptance of Terms

By creating an account, accessing, or using Flowdown, you confirm that you are at least 13 years of age and that you agree to comply with and be bound by these Terms and our Privacy Policy. If you are using Flowdown on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

3. Subscription Plans and Billing

Flowdown offers three subscription tiers:

All payments for Flowdown subscriptions are processed by Paddle.com Market Limited ("Paddle"), which acts as the Merchant of Record for all transactions. This means that Paddle is the seller of record and handles all billing, payment processing, sales tax, VAT, and invoicing on our behalf.

When you purchase a subscription, your payment relationship is with Paddle. By making a purchase, you also agree to Paddle's Buyer Terms and Conditions. Paddle will collect your payment information directly; Flowdown does not store or have access to your credit card or payment details.

3.3 Billing Cycle

Subscriptions are billed on a monthly recurring basis. Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date. Paddle will charge the payment method on file for each renewal.

3.4 Refunds

Since Paddle is the Merchant of Record, all refund requests are handled by Paddle in accordance with their refund policies. If you believe you are entitled to a refund, please contact Paddle's support through the payment receipt you received, or reach out to us and we will assist in coordinating with Paddle.

3.5 Price Changes

We reserve the right to change subscription pricing. If we do, we will provide at least 30 days' notice before the new pricing takes effect. Continued use of the Service after a price change constitutes acceptance of the new pricing.

Flowdown's Pro plan includes AI-powered features for generating and editing flowcharts. These features are powered by OpenAI. Please note:

5.1 Your Content

You retain full ownership of all flowcharts, diagrams, and other content you create using Flowdown ("User Content"). We do not claim any intellectual property rights over your User Content.

5.2 License to Operate

By uploading or creating User Content on Flowdown, you grant us a limited, non-exclusive license to store, display, and process your content solely for the purpose of providing and improving the Service. This license ends when you delete your content or your account.

5.3 Export

You may export your flowcharts at any time in PNG, SVG, JSON, or Mermaid format (depending on your plan). We encourage you to maintain your own backups of important content.

You may cancel your subscription at any time through the account settings or by contacting Paddle. Your paid features will remain active until the end of the current billing period. You may delete your account at any time, which will permanently remove your data from our systems.

We may suspend or terminate your account at any time if you violate these Terms, engage in fraudulent activity, or for any other reason at our reasonable discretion. If we terminate your account for reasons other than a Terms violation, we will provide reasonable notice where possible.

10.3 Effect of Termination

Upon termination, your right to use the Service ceases immediately. We may delete your data after a reasonable retention period following account termination. Sections of these Terms that by their nature should survive termination (such as Limitation of Liability, Indemnification, and Governing Law) will continue to apply.

Any disputes arising under these Terms that are not payment-related will be resolved through good-faith negotiation first. If negotiation is unsuccessful, disputes may be submitted to binding arbitration or the competent courts in the applicable jurisdiction.

13. Intellectual Property

The Flowdown name, logo, and all associated branding, software, designs, and documentation are the property of Flowdown and are protected by intellectual property laws. These Terms do not grant you any rights to use our trademarks or branding without prior written consent.

Flowdown integrates with third-party services to provide its features. Your use of these services is subject to their respective terms:
